Using this site, and what early access is.

Two things in one page: the rules for using magicops.co.uk, and exactly what you get — and don't get — when you ask for early access before launch.

The short version
Magic isn't launched yet. This site is information, not an offer you can accept.
Asking for early access is an enquiry. It costs nothing, commits you to nothing, and creates no contract either way.
Prices on the site are indicative until we confirm them to you in writing.
The demo number is a demo. Don't put anyone else's personal or confidential information into it.

Who you are dealing with

This site is operated by a private individual (named here on incorporation), a sole trader trading as Magic, of Manchester, United Kingdom (address for service published here on incorporation). Contact: hello@magicops.co.uk. "We", "us" and "Magic" mean that person in these terms; "you" means you or the business you are acting for.

A limited company is being registered. Until that happens there is no company number, no VAT number and no ICO reference to publish, and we would rather publish nothing than a placeholder. When the company is formed and the business transfers to it, these terms and the privacy notice will be reissued in the company's name and everyone on the early-access list will be told.

By using this site you accept these terms. If you don't accept them, please don't use it.

This is a pre-launch site

Everything on this site describes a service that is in development. Features, scripts, integrations, dashboards, timings and prices may all change before launch, and some may not ship at all. Nothing here is an offer capable of acceptance, a contractual commitment, or a promise that any particular feature will exist on any particular date. Statements about what Magic "will" do are our current intention, not a warranty.

Third-party research and statistics quoted on the site are attributed to their source, dated, and reproduced in good faith. They describe the market, not your business, and they are not a prediction of the results you will get.

What an early-access request is

It is an enquiry, nothing more. You are asking us to get in touch about the founding cohort; we are agreeing to read it and reply. No payment is taken, no card details are collected, no contract is formed, and neither of us is obliged to go any further.

aA place in the founding cohort is not guaranteed. We may decline a request, or offer the waiting list instead, for any reason — including that the cohort is full or that we don't think Magic suits your business yet.
bA service only exists once we have agreed it in writing with you, on terms of service you have seen, after the company is registered. Until then there is nothing to cancel and nothing owing.
cCohort numbers and any offer end-date shown on the site are the real figures at the time of publishing, and we update them as places go. If an offer is extended, changed or withdrawn we will say so on the page rather than leave a stale claim up.
dPlease give us your own details, or details you are authorised to give on behalf of the business you name. Don't sign up someone else's business.

Prices shown before launch

Prices on this site are indicative pre-launch prices for business customers, quoted exclusive of VAT. They are not a quotation and they can change until we confirm a price to you in writing. VAT is shown at the standard rate of 20% for illustration; we are not VAT registered yet, so no VAT is charged until we are, and if the rate or our registration status changes the price you are quoted will reflect that.

Where the site says the founding cohort keeps a rate for a period, that promise applies from your go-live date, to the plan you actually sign up to, and is confirmed in your written terms. If we can't honour it, we won't sell it to you.

The demo phone line

The number on this site connects you to an automated agent so you can hear how it handles a call. It is provided for evaluation only, on an as-is basis, with no guarantee of availability. It is not a real booking line: nothing you say to it creates an appointment, an order or any other commitment, and no one is monitoring it to act on what you tell it.

The agent tells you at the start that it is an automated assistant and that the call is recorded. The recording and its transcript are deleted as soon as the call ends — see the privacy notice. Please don't share other people's personal data, medical details, payment details or anything confidential with it. Your own network's call charges apply.

Acceptable use

Don't submit false or automated signups, scrape or bulk-download the site, try to break into or overload it, probe it for vulnerabilities without asking us first, reverse-engineer the demo, use the site or the demo line to break the law or harass anyone, or copy the site's design or copy for a competing product. We may block access or remove data if you do. If you find a security problem, email us and we will thank you properly.

Intellectual property

The Magic name, the site, its design, copy, code, dashboards and the demo agent's scripts belong to us or our licensors. You may read the site, print it and share links to it. You may not copy, adapt or republish any substantial part of it, or use our name or branding, without our written permission. Third-party research quoted on the site remains the property of whoever published it.

If you send us feedback or ideas about the product, we may use them freely to improve Magic without owing you anything for them. That isn't us claiming your business information — just making clear that "you should add X" doesn't become a debt.

No warranties, and limits on liability

The site and the demo are provided as they are, without warranties of any kind, express or implied, to the fullest extent the law allows. We don't promise the site will be available, uninterrupted or error-free, that the information on it is complete or current, or that it is free of anything harmful — though we take reasonable care on all counts.

We are not liable for any business loss arising from your use of this site or the demo line — including lost profit, lost revenue, lost or missed business, lost data, wasted expenditure or any indirect or consequential loss — or for anything you do or don't do in reliance on statements about a product that hasn't launched.

Where we are nonetheless found liable in connection with this site or the pre-launch process, our total liability is capped at £100, reflecting that nothing is charged at this stage.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded. If you are dealing with us as a consumer rather than for a business, nothing here affects your statutory rights.

Links, changes and the law that applies

Where we link to someone else's site — research sources, for example — we don't control it and aren't responsible for it. We may change these terms as the product and the business change; the version and date at the top tell you which set applies, and the current version governs your use of the site from the moment it's published. We may change or withdraw any part of the site, or the demo line, at any time.

These terms and any dispute arising from them are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If any part of these terms is unenforceable, the rest stands. Personal data is dealt with in the privacy notice, which forms part of these terms.
